Official documents... and their legal arguments.

Proving obligations and debts between parties has legal force if done in writing, but the degree of evidentiary force of written documents varies depending on their nature and type. These may include private documents issued against the party being proven against, or correspondence between the parties, commercial records, or other documents. Written documents can also be official documents, which are the strongest in terms of proof and can be used against everyone if the necessary legal conditions are met. Article 216 of the Civil and Commercial Proceedings Law defines an official document as those documents in which a public official or a person entrusted with public service proves what is done or received by them, in accordance with the legal provisions and within their authority and jurisdiction. Thus, a document acquires the status of an official document if it meets a set of conditions, namely that the document is issued or signed by a public official or a person entrusted with public service. This means that the information and data contained in the official document must come from a person in a government agency or a person in a public sector. If the document is issued by a private individual or a person who is not entrusted with public service, the document loses its official status. It is also stipulated that the official document must be issued by a public official, who must have either drafted, signed, or acknowledged the document, and must have indicated that they have read and approved its contents. In addition to the above conditions, it is essential that the official document issued by a public official in accordance with the laws and regulations is issued within the scope of his authority and powers. If the public official exceeds his authority, the document loses its official status. For example, a public official may issue a document authorizing a person to build a structure that violates the required regulations and conditions for obtaining building permits. In addition to the above conditions, it is also essential that the official document issued by a public official in accordance with the laws and regulations is issued within the scope of his authority and powers. If the public official exceeds his authority, the document loses its official status. For example, a public official may issue a document authorizing a person to build a structure that violates the required regulations and conditions for obtaining building permits. Once a document acquires official status, it has evidentiary value and can be used as evidence by all parties, regardless of whether they are parties to the document. No one can deny its contents except through the legally prescribed means, i.e., by challenging its validity based on forgery. Regarding the image of the official document, it does not have the same evidentiary value as the document itself, even if it contains the same content. This is because it remains a mere image with different connotations. Therefore, the legislature considers that if the original official document is present, its image has the same evidentiary value if it is identical to the original. If the original document is not present, the image is considered a mere piece of paper and can be denied.

What are the conditions for appointment to a government position?

Employment in government agencies is linked to the actual needs of each agency for a workforce that is appropriate for its competencies and the nature of its work. According to the national legislative policy, government employment is considered a national service whose purpose is to develop the sector in which it operates, rather than being a source of income for those seeking employment. Appointments to civil government positions are subject to the provisions of Law No. 15 of 2016 regarding the issuance of the Civil Human Resources Law, particularly Article 6, which specifies how government positions are filled, emphasizing that this should be done within the actual needs of the government sector, in the presence of an available government position, with priority given to job seekers registered with the Ministry of Social Development and Family, provided that the principle of competence and merit is applied in selecting candidates for appointment. Government employees are appointed either by royal decree or by the competent authority for positions that require it. Appointments can also be made through employment contracts according to the applicable models, or through special contracts for employing individuals with specific skills or rare specializations. It is also possible to appoint employees through temporary contracts with a fixed salary for a period not exceeding six months, which can be renewed for a similar period. Furthermore, civil government positions can be filled through special employment contracts for non-Qatari employees. Article 13 of the Civil Human Resources Law stipulates eight mandatory conditions for a person wishing to be appointed to a civil government position. Failure to meet any of these conditions results in the loss of the right to the position. These conditions are: firstly, being a national; secondly, being the children of Qatari nationals with foreign nationalities; thirdly, being the spouses of Qatari nationals; fourthly, being citizens of the Gulf Cooperation Council countries; fifthly, being citizens of Arab countries; and sixthly, being foreigners. The seventh condition is that the applicant must be eighteen years of age or older, and free from any disqualifying conditions. The eighth condition is that the applicant must possess the qualifications and conditions required for the position. For example, if the position requires the applicant to have a master's degree and at least three years of professional experience, the absence of either of these conditions would disqualify the applicant from being considered for the position. In addition to the conditions of competence and experience, other mandatory conditions for appointment to civil government positions include passing tests and competitions, and undergoing training programs as determined by the government agency. Other mandatory conditions that determine a person's eligibility for the position, in addition to competence and experience, include conditions related to physical fitness, conduct, and reputation. The legislator stipulates that the applicant must be physically fit to perform the duties required by the position. To this end, the applicant must submit with their application a medical certificate proving their physical ability to perform the duties of the position. The candidate must also have a good reputation and conduct, which must be proven by a certificate of good conduct obtained from the authorized authority. Furthermore, it must be established that no final criminal judgment has been issued against the candidate for an offense that violates honor or trust, unless the candidate has been exonerated. Additionally, the candidate's file must be free of any final disciplinary sanctions issued against them or any termination from service.
